Prison Rape Elimination Act (PREA)

It is the policy of the Richmond Juvenile Detention Center (RJDC) to fully comply with the Prison Rape
Elimination Act (PREA) and the National Standards promulgated by the United States Department of
Justice to prevent, detect, and respond to prison rape under PREA and to provide a safe, humane,
and secure environment for all residents free of sexual abuse and sexual harassment.

Zero-Tolerance for Sexual Abuse or Sexual Harassment  115.311

The Richmond Juvenile Detention Center has a zero tolerance for all forms of sexual abuse and sexual
harassment. It is also RJDC’s priority to prevent, detect and respond to such conduct through policy,
procedure, training and practice. Every allegation of sexual assault, misconduct and harassment is
thoroughly investigated, and all reports of sexual assault are referred to the Richmond City Police
Department
for criminal investigation and/or Child Protective Services (DSS).

This brochure is given to every resident upon intake. It outlines what sexual abuse and harassment
is and more importantly, how residents can report if they become a victim while in detention. Included
within the brochure are several telephone numbers victims can call to report the abuse and also to
receive counseling or services from a victim advocate.

Allegation Referral  115.322

Tell any staff member at RJDC.

It is part of staff responsibility to report any allegation, ensure the resident’s safety, and maintain
confidentiality as a mandatory reporter. Send a letter and/or call the Superintendent or Assistant
Superintendent(s) of RJDC, the Department of Juvenile Justice, or Child Protective Services (DSS).

RJDC are responsible for complete and prompt investigations of all complaints and allegations made
against and within the RJDC for which they have regulatory authority. If it becomes necessary, the
Richmond City Police Department will be contacted when there is a possibility of criminal charges.

Third Party Reporting  115.354

A grievance ( complaint form ) may be filed by a third party such as staff members, family members,
attorneys, and fellow residents or any other interested party. These third party reports of sexual abuse
may be reported in person, in writing, or by telephone. The resident does not need to agree to have the
complaint filed. These individuals may also assist residents in filing requests for administrative remedies
relating to sexual abuse.
